Rig Dash — Terms of Service

1. What these terms are
These terms are an agreement between you and us about your use of the Rig Dash website and app at rigdash.netlify.app (the “Service”). By creating an account, tapping “Get Started,” or otherwise using the Service, you agree to them. If you don’t agree, don’t use the Service.
1A. Rig Dash is in alpha
Rig Dash is an early “alpha” test version. It may have bugs, show wrong or missing information, change without notice, go down, or be reset, and information you save or post may be lost or removed. Use it alongside your regular GPS and your own judgment, and never rely on it alone for a route, a restriction, a law, or a tax figure.
2. Who can use it
You must be at least 18 and able to form a binding contract. Rig Dash is built for professional drivers, but you don’t need a CDL to use it. You must give accurate account information and keep your sign-in secure. You are responsible for what happens under your account.
3. Safety — read this first
- Don’t use Rig Dash while driving. Look at it and touch it only when you are safely stopped and it is lawful to do so. Follow all laws about phones and distracted driving.
- You are the driver. You alone are responsible for how you operate your vehicle, where you drive, and whether a road, bridge, or route is safe and legal for your rig. Posted signs, officers, and conditions on the road always come before anything the Service shows.
4. Truck routes and other information are aids, not guarantees
Truck routing. Routes come from a third-party mapping provider and are planned using the height, width, length, weight, axles, and hazmat information you enter. That data can be incomplete, out of date, or wrong — including low bridges, weight limits, truck-banned roads, closures, construction, and turn restrictions. If the information you enter about your truck or load is wrong, a route may not be legal or safe for your rig. We do not guarantee any route is safe, legal, shortest, fastest, or toll-free, even when you choose “Avoid toll roads.”
Everything else. Weather, road conditions, truck stops, parking, fuel prices, weigh stations, Bear Watch sightings, bridge laws, regulations summaries, drive times, mileage, and costs are provided for general information. Some come from other drivers and may be wrong, late, or missing. Laws change; the state bridge law list and the FMCSA library are summaries with links to sources, not legal advice.
IFTA, mileage, and money tools. The IFTA fuel log, GPS mileage by state, return calculation, load profit checker, and cost-per-mile calculator are estimates built from numbers you and your phone provide. GPS mileage is only counted while the app is open and can be wrong or incomplete. Tax rates are entered by you. This is not tax, legal, or accounting advice, and you are responsible for the accuracy of any tax return or record you file or keep. Check everything against your own records before you rely on it or file it.
5. Your account and your data
You can use much of the Service without an account, but some features need one, including posting reports, sending feedback, and saving your information to your account so it follows you to other phones. Posting reports requires an account with a verified email address. How we handle your information is described in our Privacy Policy.
6. Reports and other content you post
You can post things like Bear Watch sightings, road condition reports, parking, weigh-station, and fuel-price updates, places you add to the map, trivia names, and feedback (“Your Content”).
- You own it, and you give us permission to use it. You keep your rights in Your Content. You give us a worldwide, free, non-exclusive license to host, store, display, copy, and use Your Content to run and improve the Service, including showing it to other users. This license continues for content that is already shared with others after you stop using the Service or close your account, as needed to keep the shared map consistent.
- Be honest and be lawful. Don’t post anything false, misleading, abusive, unlawful, or that you don’t have the right to post. Don’t post a report to mislead other drivers, to harass anyone, or to interfere with lawful law enforcement or emergency operations.
- Other drivers’ content isn’t ours. Content from other drivers is theirs, not ours, and we don’t promise it is accurate.
- We can remove it. We can review, remove, or hide any content and restrict any account, at any time, for any reason, including to keep the map reliable. Some content (such as a Bear Watch sighting) only appears after enough different drivers report it, and may stop showing after a short time.
- Reports may be shown without your name. We show reports to other users without your name or email, but they are stored with an account identifier, and our administrators can see it. See the Privacy Policy.
7. Bear Watch
Bear Watch lets drivers share where they’ve seen law-enforcement activity so other drivers know what’s ahead. Use it to drive more safely and lawfully, not to break the law. Don’t use or rely on it to evade enforcement, speed, or break any law, and don’t post anything about law enforcement that is false. Whether and how a feature like this may be used varies by place and by type of vehicle, and you are responsible for following the laws wherever you drive. We may limit, change, or turn off Bear Watch (including in some places) at any time, and we may remove or refuse to display any sighting. Sightings are provided by drivers, are not verified, and may be wrong or out of date.
8. Rules for using the Service
Don’t: (a) break any law or anyone’s rights; (b) interfere with or overload the Service, or try to get around its limits or security; © scrape, copy, or resell its data or maps without our permission; (d) use another person’s account or pretend to be someone else; (e) post spam or fake reports, or set up accounts to inflate confirmations; (f) reverse engineer the Service except as the law allows; or (g) use it in a way that creates a safety risk to anyone.
9. Third-party services
The Service uses services run by others, including Google (sign-in and our database), Netlify (hosting), HERE (truck routing), OpenStreetMap and Esri (maps), the U.S. National Weather Service and RainViewer (weather), the U.S. Census Bureau and others (address search), and state transportation agencies (work zones). They have their own terms and privacy practices, and we don’t control them. They can change or stop working, and the Service may be affected.
10. Fees
The Service is currently free. If we ever add paid plans, we will tell you the price and the terms before you are charged anything.
11. Our rights
We own the Service, including its design, software, name, and logo, other than Your Content and third-party material. We give you a limited, personal, non-exclusive, non-transferable license to use it under these terms. Feedback you send us can be used by us without obligation to you.
12. Ending your use
You can stop using the Service at any time, and you can delete your account yourself in the app (More → Account & Sync → Delete my account), which erases your account, saved data, and the reports and places you posted. We can suspend or end your access at any time, including for breaking these terms. Sections that by their nature should survive (including 4, 6, 12, 13, 14, 15, and 16) will survive.
13. No warranties
The Service is provided “as is” and “as available.” To the fullest extent the law allows, we make no promises that it will be accurate, complete, uninterrupted, secure, or error-free, or that it is fit for any purpose, and we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Some places don’t allow some of these limits, so some may not apply to you.
14. Limits on our responsibility
To the fullest extent the law allows, we and the people who make Rig Dash are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost income, lost data, fines, tickets, tolls, delays, damage to vehicles, cargo, or property, or personal injury, arising from or connected to your use of (or inability to use) the Service, including any route, report, estimate, or information in it. Our total responsibility for any claim relating to the Service is limited to the greater of the amount you paid us in the last 12 months or $100. These limits apply to the extent the law allows, and don’t limit liability that can’t be limited by law.
15. You’ll cover claims you cause
To the extent the law allows, you will defend and cover us against claims, losses, and costs (including reasonable legal fees) that come from your misuse of the Service, Your Content, or your breaking these terms or the law.
16. Disputes, governing law, and changes
Governing law and place. These terms are governed by the laws of the Commonwealth of Virginia, and disputes will be brought in the state or federal courts located in Virginia.
Changes. We may update these terms. If a change is important, we’ll tell you in the app or by email before it takes effect. Using the Service after a change means you accept it.
The rest. If part of these terms isn’t enforceable, the rest stays in force. These terms (with the Privacy Policy) are our whole agreement about the Service. You can’t transfer them without our consent; we can transfer them in a sale or merger. Not enforcing a term isn’t a waiver of it.
